Abstract

Breach of contract within kinship networks can cause financial loss and weaken trust. This article examines how
Mandailing deliberative values can inform a settlement model consistent with Indonesian contract law. It employs
doctrinal research through statutory and conceptual approaches and socio-legal literature published before 2026.
Findings from earlier studies serve as secondary material; no new interviews or observations were undertaken. The
analysis distinguishes cultural identity, recognition of customary law communities, social legitimacy, and the legal force
of settlement instruments. It proposes six stages of the Mandailing Martahi Contractual Relations Model: clarification
of obligations and evidence, voluntary family deliberation, neutral social mediation, proportionate remedies, written
documentation, and access to formal mechanisms. Safeguards protect free consent, equal participation, and both parties'
rights. Rescheduling is distinguished from novation, and commercial hardship does not automatically establish force
majeure. Private settlements, notarial deeds, and judicial deeds of settlement have distinct effects. A hypothetical oral
loan illustrates the analytical sequence without establishing effectiveness. The contribution is a procedure requiring
empirical validation and assessment against mediation and judicial practice.
