Applicable Article Licence: Creative Commons Attribution-ShareAlike 4.0 International (CC BY-SA 4.0)
Juris Sinergi Journal (hereinafter referred to as the “Journal”) is committed to the immediate, equitable, and enduring public availability of peer-reviewed legal scholarship. The Journal operates as an open access scholarly journal and makes its published research articles freely available to the public, in accordance with the principles of the Budapest Open Access Initiative and the Principles of Transparency and Best Practice in Scholarly Publishing jointly developed by the Committee on Publication Ethics (COPE), the Directory of Open Access Journals (DOAJ), the Open Access Scholarly Publishing Association (OASPA), and the World Association of Medical Editors (WAME).
These references identify standards and guiding principles; they shall not be construed as a representation that the Journal is accredited, indexed, or a member of any named organisation.
This Statement shall govern public access to, the licensing of, and the lawful reuse of scholarly articles published by the Journal. Copyright and licensing notices displayed on an individual article shall be read together with this Statement, subject to the provisions concerning previously published articles and third-party materials below.
All scholarly articles published by the Journal shall be made available online immediately upon publication, without an embargo period, subscription fee, pay-per-view charge, mandatory reader registration, or other access condition that would prevent the lawful consultation of their full text.
Readers may access, read, download, print, search, and link to the published material without prior permission. Subject to the applicable open licence and third-party rights, published articles may also be copied, shared, redistributed, indexed, text-and-data mined, and otherwise used for lawful scholarly, educational, professional, public-policy, and commercial purposes.
The foregoing undertaking concerns free access for readers and shall not be interpreted as a representation that publication services are necessarily free of charge to authors.
Unless a particular article contains a valid and expressly identified different licence notice, scholarly articles published under this policy shall be made available pursuant to the Creative Commons Attribution-ShareAlike 4.0 International Licence (CC BY-SA 4.0).

Full legal code: https://creativecommons.org/licenses/by-sa/4.0/legalcode
Under CC BY-SA 4.0, users are permitted, including for commercial purposes, to:
These permissions are subject to the licence's legally binding terms, including the duties of attribution and ShareAlike. This Statement does not amend, narrow, or impose additional restrictions upon the Creative Commons licence.
Persons relying on the CC BY-SA 4.0 licence shall provide appropriate credit to the author or other designated attribution parties, retain relevant copyright and licence notices, provide a link to the licence, and indicate whether changes have been made. Attribution shall not imply endorsement by an author, the Journal, or the Publisher.
Where a user distributes an adaptation of a licensed work, the user's contributions to that adaptation shall be licensed under CC BY-SA 4.0 or another licence formally designated as compatible under the Creative Commons framework, in accordance with the governing licence.
The Journal encourages users to cite the author, article title, journal title, publication year, and persistent article identifier, including the DOI where available, in accordance with scholarly citation practice. This encouragement shall not operate as an additional legal condition beyond the applicable licence.
No person may impose technological protection measures or additional legal terms that restrict the exercise of rights conferred by CC BY-SA 4.0.
Authors shall retain copyright in their original scholarly contributions, except where ownership lawfully vests in another rights holder by operation of law or a separate valid agreement duly disclosed to the Journal.
By accepting publication under this Statement, the author or authorised rights holder grants the Journal and its Publisher a non-exclusive right of first publication, together with the rights reasonably required to edit, reproduce, publish, communicate, disseminate, index, register relevant metadata, and preserve the article under the stated open licence.
The grant of publication rights shall not, by itself, constitute a transfer of copyright or an exclusive assignment of the author's economic rights to the Journal or Publisher. Authors remain responsible for ensuring that they possess authority to grant the rights necessary for publication.
The Journal shall identify the relevant copyright holder and licence on each article's landing page and, as far as technically practicable, in the article's full-text formats and associated metadata.
Authors may make their own preprints, accepted manuscripts, and published Versions of Record available through personal academic websites, institutional or subject-based repositories, and other lawful scholarly dissemination channels, without an embargo imposed by the Journal, subject to applicable third-party rights and any restrictions binding the relevant version before publication.
Whenever the published Version of Record is deposited or shared, authors and repository managers shall retain the applicable copyright and CC BY-SA 4.0 notices, clearly identify the published version, and provide a link to the Journal's official article page and DOI, where available.
A preprint or accepted manuscript shall be labelled accurately to avoid representing an unreviewed or uncorrected version as the definitive published article. The licence applicable to each version shall be identified accurately rather than presumed solely from the publication licence.
The Journal's open licence applies only to material for which the relevant rights holder is entitled to grant that licence. It shall not be presumed to extend to third-party photographs, figures, datasets, maps, extracts, or other protected material incorporated under permission or a statutory exception unless such material is expressly included within the open licence.
Legal materials—including legislation, judicial decisions, governmental documents, and official records—shall be cited accurately and treated in accordance with the copyright, access, confidentiality, and other rules governing their respective jurisdictions. The public availability of a legal source shall not, of itself, establish that the source is in the public domain.
Authors shall secure necessary permissions for third-party material and shall identify any exclusion from the article's Creative Commons licence in an appropriate caption, credit line, or rights statement.
Nothing in this Statement purports to override applicable privacy, confidentiality, data-protection, moral-rights, personality-rights, or other legal obligations.
No reader shall be required to pay for online access to the Journal's published scholarly articles. Any manuscript submission, processing, or publication charges assessed to authors shall be separate from reader access and shall be disclosed transparently in the Journal's Author Fees policy at https://journal.sinergilp.com/index.php/jsj/AuthorFees.
Any applicable fees, the point at which they become payable, and any waiver or refund arrangements shall be governed by the publicly disclosed policy in effect for the relevant submission. Payment of a fee shall not guarantee manuscript acceptance or publication and shall not impair the independence of editorial and peer-review decisions.
Open access shall not dispense with the Journal's standards concerning research integrity, rigorous editorial evaluation, and independent peer review. The Journal shall apply its Publication Ethics, Publication Process, and Reviewer Guidelines to manuscripts considered for publication.
The Journal shall identify the authoritative published Version of Record and, where applicable, make corrections, expressions of concern, retractions, and other post-publication notices publicly accessible and appropriately linked to the affected article. Such notices shall preserve the transparency of the scholarly record and shall not ordinarily be concealed behind an access restriction.
The Journal shall seek to make article metadata, bibliographic information, abstracts, persistent identifiers where assigned, and published full texts accessible to lawful scholarly discovery, indexing, and preservation services in accordance with the applicable licences and technical requirements.
The Journal and Publisher shall maintain appropriate backup and preservation arrangements and shall disclose any verified long-term digital preservation service or archive in a dedicated archiving policy or other publicly accessible statement. No specific external preservation membership or repository participation is represented by this Statement unless separately confirmed and disclosed by the Journal.
The Journal shall endeavour to ensure that this Statement is consistent with its Author Guidelines, Copyright Notice, Author Fees, and article-level licensing metadata.
The licence and copyright status of articles published before the adoption of this Statement shall continue to be determined by the valid notices and rights arrangements applicable to those articles. This Statement shall not retrospectively transfer copyright, replace an existing licence, or alter previously granted rights without a proper legal basis and any required consent.
Where conflicting descriptions appear elsewhere on the Journal's website, the Publisher shall review and correct the affected policy documents. The governing rights in a specific article shall be evaluated by reference to its valid rights notice and any applicable agreement, rather than by treating a general website statement as an automatic amendment of past rights.
The Editor-in-Chief and Publisher shall be responsible for implementing and periodically reviewing this Statement. Any amendment shall be published transparently and shall not purport to revoke permissions already granted under an applicable irrevocable Creative Commons licence.
Questions regarding access, licensing, repository deposit, or permissions not covered by the applicable licence may be referred to the Journal through its official contact channels.
